ARPOA BOARD MEETING

April 12, 2005

 

Member Present: Walter Bigelow, Anastasia Hopkinson, Bonnie Persinger, Dan Santin, Steve Stroetzel.

President’s Report:

1.  Stamato/Ribera Development Inc. lawsuit.

The President reported that this lawsuit is by the developer who failed to get a contract on the 33 acres, but currently has a contract on the Golf Course.  The lawsuit is a request for release of the 1987 covenants on the Golf Course.  No claims are made for damages, nor were claims made on individuals or on ARPOA.  The lawsuit has little merit and will hopefully be dismissed within 30 days.  The President has also asked the Blumenthal, Delavan & Williams to assume the role of ARPOA's Resident Agent, in place of Larry Beers, former ARPOA Board President.

2.  Green Willow lawsuit & property acqusition.  The President reported that both ARPOA and the property owner (Barrow Builders) are cooperatively asking the courts to delay any action during property acquisition negotiations.  The President also reported that a draft contract is presently being reviewed by the seller/owner, Barrow Builders. 

3.  Hurricane Isabel Repairs.  The President reported on repair plans for the Overlook and beach area directly below.   Consultant John Flood's plans are to establish offshore breakwaters with rocks laying just at water level; and to fill in the area between the breakwaters and the land with sand spits.  The filled-in area would be planted with bushes which will prevent erosion but not prevent views of the Severn River.  Trucks are scheduled to arrive in late July to begin this project.  In addition, John Flood is resubmitting an original grant request of $65,000 for a new grant of $83,000 to pay for materials.  ARPOA will be responsible for paying labor costs, estimated currently at $60,000.

 

PWD Report: 

1.  Grass cutting service (not Terry Wright) mistakenly cut bushes at the Overlook.  On 4/10 John Flood surveyed the situation and the PWD reviewed with AA County rep. Gene Paterson, who said it was excusable.

2.  Isabel Damage:  Carrollton Rd at Lands End has buckled due to water underneath.  Two bids to make repairs have been received; one for $4850 & one for $6900.  Two more proposals are pending.

3.  New gravel will be placed on the beach room, from Carrollton to the Overlook to improve the access road.  Extending the road for a parking pad requires a permit and will not be addressed at this time.

4.  The PWD contacted Dick Hewlitt of AA County, regarding the County’s claim to ownership of the Green Willow Rd.

5.  The PWD informed the Board that Terry Wright has claimed he is due reimbursement for services rendered. Mr. Wright cuts at front entrance and White Gates.  Mr. Wright was instructed to provide invoices (monthly, itemized) and a copy of ARPOA’s contract for review by the Board. 

6.   Merill Plait, AA County DPW Environmental Engineer, will meet with the PWD in a couple of weeks to review storm water management issues.

 

Treasurer’s Report:

1.  The second pre-settlement payment was presented to the owner of the Ogleton Woods property on Monday 4/11/05.

2.  Financing the Ogleton Woods 33-acre acquisition.  The Treasurer reported that three to five bank proposals for MDE Link-Deposit long-term low-interest loans will be available for Board review soon.

 

Old Business:

The Annual Summer Meeting - The Board chose the date of Saturday June 25, 2005, for this years meeting.

 

New Business:

Director Santin asked when AA County last repaved the roads, notably Carrollton Rd.  The PWD stated that he has a request into the County for that information.

It was suggested and the Board selected Saturday May 7, 2005, for the annual ARPOA Spring Fling community clean-up day.  Beverages and snacks will be provided to the volunteers.

 

The next meeting is scheduled for May 3rd. at the house of Walter Bigelow.
